1. Website owner, our offering, and binding of T&C's

This website is owned and operated by Sugaring & Beauty, powered and secure by WIX. These terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors information about services related to beauty treatments, body treatments and hair removal in the form of sugaring as well the possibility to book the mentioned treatments, information about professional sugaring trainings as well as the possibility to book those mentioned trainings, and information about skincare and bodycare products as well as the possibility to buy them in our online-shop. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these terms.

2. Who can use our website? What are the requirements to create an account?

In order to use our website and/or receive our services and/or to create an account, you must be at least 18 years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into these terms as a binding agreement. You are not allowed to use this website and/or receive services and/or create and account if doing so is prohibited in your country or under any law or regulation applicable to you.

3. Key commercial Terms offered to our customers

When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.

The prices we charge for using our services / for our products / for our trainings are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. Additional information about pricing and sales tax is available on the payments page.

The fee for the services and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your payment method.

4. Return and refund policy

For any undamaged product, simply return it with its included accessories and packaging along with the original receipt (or gift receipt) within 14 days of the date you receive the product, and we will exchange it or offer a refund based upon the original payment method. In addition, please note the following: (i) Products can be returned only in the country in which they were originally purchased; and (ii) the following products are not eligible for return: beauty treatments, body treatments, and sugaring trainings (see specific T&C's for sugaring traininings).

5. Retention of right to change offering

We may, without prior notice, change the services and/or products; stop providing the services and/or products or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.

6. Warranties & responsibility for services and products

When we receive a valid warranty claim for a product purchased from us, we will replace the product. If we are unable to replace the product within a reasonable time, the customer will be entitled to a full refund upon the prompt return of the product to us. We will pay for shipment of replaced products to customer and customer will be responsible for return shipment of the product to us.

7. Ownership of intellectual property, copyrights and logos

The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Sugaring & Beauty. Except as explicitly provided herein, nothing in these terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.

8. Right to suspend or cancel user account

We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment

9. Indemnification

You agree to indemnify and hold Sugaring & Beauty harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against them by any third party due to, or arising out of, or in connection with your use of the website or any of the services offered on the website.

10. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Sugaring & Beauty, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the service.

To the maximum extent permitted by applicable law, Sugaring & Beauty assumes no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of our service; and (iii) any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

11. Right to change and modify terms

We reserve the right to modify these terms from time to time at our sole discretion. Therefore, you should review these page periodically. When we change the terms in a material manner, we will notify you that material changes have been made to the terms. Your continued use of the Website or our service after any such change constitutes your acceptance of the new terms. If you do not agree to any of these terms or any future version of the terms, do not use or access (or continue to access) the website or the service.

12. Promotional emails and content

You agree to receive from time to time promotional messages and materials from us, by mail, email or any other contact form you may provide us with (including your phone number for calls or text messages). If you don't want to receive such promotional materials or notices – please just notify us at any time.

13. Preference of law and dispute resolution

These terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of United Kingdom, England, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in London (United Kingdom). The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

TERMS & CONDITIONS (T&C's) for sugaring trainings

- of the Sugaring Academy of Sugaring & Beauty
- in training centers commissioned by the Sugaring Academy of Sugaring & Beauty

1. By registering online, the registering participant concludes a legally binding contract - including these Terms & Conditions (T&C's) for sugaring trainings - to participate in the registered training with the Sugaring Academy of Sugaring & Beauty, as the number of participants in the training is limited. The registration deadline is one week before the start of the training. By sending the online registration form, the participant confirms that they are suitable for the selected training. If the participant is not suitable, they remain obliged to pay the workshop fee.

2. The online registration made in accordance with section 1 is binding and leads to the conclusion of a legally binding contract with the Sugaring Academy of Sugaring & Beauty. A separate confirmation of participation from the Sugaring Academy of Sugaring & Beauty is not required. Invoices will only be sent by email to the email address provided by the participant.
Please note that all deposits are non-refundable or transferable unless within 14 calendar days of booking (in accordance with the Customer Contracts Regulations).

EASY PAYMENT PLAN
The full balance is payable prior to the start of the training, however we offer participants the following instalment plans for our core and sugaring career trainings - interest free.

Sugaring Core Training:

Our Sugaring Core Training is eligible for payment in 2 monthly instalments.
A 20% deposit will secure your place, followed by 2 monthly instalments of £279.60.
Payments must be made by bank transfer on the 1st of each month until the training fee is paid in full.
Please note that if a participant leaves the course early then the full balance becomes payable immediately.

Sugaring Career MINI:

Our Sugaring Career MINI (incl. epiladerm product package) is eligible for payment in 3 monthly instalments.
A 20% deposit will secure your place, followed by 3 monthly instalments of £266.40.
Payments must be made by bank transfer on the 1st of each month until the training is paid in full.
Please note that if a participant leaves the course early then the full balance becomes payable immediately.

Sugaring Career MIDI:

Our Sugaring Career MIDI (incl. epiladerm product package) is eligible for payment in 5 monthly instalments.
A 20% deposit will secure your place, followed by 5 monthly instalments of £249.44.
Payments must be made by bank transfer on the 1st of each month until the raining fee is paid in full.
Please note that if a participant leaves the course early then the full balance becomes payable immediately.

Sugaring Career MAXI:

Our Sugaring Career MAXI (incl. epiladerm product package) is eligible for payment in 8 monthly instalments.
A 20% deposit will secure your place, followed by 8 monthly instalments of £209.90.
Payments must be made by bank transfer on the 1st of each month until the raining fee is paid in full.
Please note that if a participant leaves the course early then the full balance becomes payable immediately.

3. COVID-19 Restrictions: All courses are subject to the above whilst the Covid19 exists. Where symptoms of Covid19 exist before the relevant course date(s) or on the day of the course, students will be encouraged to cancel the planned course dates, and will be excused from the course to avoid transmission risks and to comply with Government Legislation. Please contact us as soon as possible by email or telephone to notify the school if you become or suspect you have become symptomatic. Course fees will be transferred to the next available course date and students should liaise with us to discuss alternative dates. Please note that course fee refunds will not be given, other than the statutory cancellation regulations under Customer Contracts Regulations. This states that course deposits all deposits are non-refundable or transferable unless within 14 calendar days of booking.

4. Cancellations:

All deposits are covered by the Consumer Contracts Regulations and are subject to a 14-calendar day cooling off period, after which the deposit becomes non-refundable. Following this, the participant is then liable for the balance of the training fee. Whether this is by single payment or our easy payment plan, even in the event of the participant failing to complete the training through illness or non-attendance.
All training fees are non-refundable unless we are obliged to cancel a training – this would be in response to low enrolment numbers. In the unlikely event that we are forced to cancel a training for this reason, we reserve the right to contact you 7-14 days prior to the training starting and advise you of such.
If a training is canceled due to force majeure, as a result of the illness of the responsible trainer or due to other, unforeseeable events, the participant is not entitled to compensation. The training will then be rescheduled at a later date. In the event that the replacement training cannot take place, the participant will receive a refund of the training fee that has already been paid.
Trainings run subject to minimum enrolments. We will keep trainings open for as long as is possible to enable participants to book. We endeavor to give the training as good a prospect of recruiting as we possibly can. However, if it becomes apparent that training enrolments are too low, we will offer alternative training dates, or if unsuitable, reimburse your deposit.
For 1 or 2 day trainings – once the deposit has been paid and then a participant cancels more than 4 weeks in advance of the start date, then a Cancellation Fee of £25 will be charged and also 50% of the training fee will become payable immediately. The cancellation must be made in writing and/or by email (judith@sugaringandbeauty.co.uk) directly to the Sugaring Academy of Sugaring & Beauty. Cancellation verbally over the telephone is not possible.

4. All training fees must be paid by the participant. The participation of a replacement person is possible after consultation with the Sugaring Academy of Sugaring & Beauty. The training fee will be invoiced to the participant by the Sugaring Academy of Sugaring & Beauty.

5. The current training fees are published on the website www.sugaringandbeauty.co.uk.

6. All training documents/manuals and the products necessary for the training, drinks and sweets are included in the training fee. For in-house trainings, only the training documents/manuals are provided. The products required for the training will be provided by either the participants or the Sugaring Academy of Sugaring & Beauty after individual consultation and price agreement. Meals must be provided by the participants.

7. The participant takes part in the training at his own risk and responsibility. The trainer is liable for material and/or immaterial damage caused culpably to the participant by the responsible trainer during the training. The Sugaring Academy & Sugaring & Beauty generally assumes no liability.

8. The Sugaring Academy of Sugaring & Beauty, in collaboration with the responsible trainer, is legally responsible for the implementation and guarantee of the training content as well as for the quality of the trainings offered.

9. Copyright: By registering online, the participant confirms that he is aware that all training content is subject to copyright and is therefore protected by copyright, product and trademark law.

10. To the extent permitted by law, the country of fulfillment for the participant contract is the United Kingdom. To the extent permitted by law, the place of jurisdiction for the participant contract is London (United Kingdom).

11. Subsidiary agreements and other agreements to this contract must be in writing to be legally valid. This also applies to the waiver of this written form clause.

12. If one or more regulations of these Terms & Conditions (T&C's) for sugaring trainings are or become ineffective, the effectiveness of the remaining regulations will not be affected. The ineffective regulation will be replaced by the relevant legal regulation.

13. By registering online, the participant confirms that they have read and taken note of these Terms & Conditions (T&C's) for sugaring trainings.
